Description

This case alleged a violation of RCW 42.17A.700 against Anthony Martinelli (the “Respondent”) for failure to timely file a Personal Financial Affairs Statement (F-1 report) disclosing 2020 financial activity, and was resolved with a formal written Warning Letter. 

PDC staff reviewed the allegations and evidence submitted; the applicable statutes, rules, and reporting requirements; and the applicable PDC reports filed by the Respondent to determine whether the record supports a finding of one or more violations.

Based on staff’s review, we found the following:

  • The Respondent is a former City Council Member for the City of Des Moines. His term in office was January 1, 2020 through January 21, 2022.
  • As an elected official who held office in 2021, the Respondent was required to file an F-1 report by no later than April 15, 2021, disclosing financial activity for 2020. 
  • PDC records indicate that the Respondent filed the F-1 report covering 2020 on June 17, 2021, which is 63 days late. He did not provide the PDC with a response to the allegation in this case, indicating why the report was late. 
  • The Respondent’s filing history shows a pattern of late or unfiled F-1 reports in 2020, 2021 and 2022, disclosing 2019, 2020 and 2021 financial activity respectively. To date, the Respondent has not filed the F-1 report disclosing 2021 financial information. 

Based on our findings, staff has determined that, in this instance, failure to timely file the annual F-1 report covering 2020 does not amount to a violation that warrants further investigation.

Pursuant to WAC 390-37-060(1)(d), the Respondent, Anthony Martinelli, received a formal written Warning concerning his failure timely disclose 2020 financial information on a Personal Financial Affairs Statement (F-1 report). The formal written Warning included staff’s expectation that Anthony Martinelli timely file all future required F-1 reports. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.

Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
