Description
The Public Disclosure Commission (PDC) has completed its review of the complaint filed by Glen Morgan on August 24, 2017. Your complaint alleged that Carolyn Merrival, a Pierce County Charter Commissioner may have violated RCW 42.17A.700 for failure to timely file Personal Statements of Financial Affairs (F-1 reports) certifying financial activities for twelve calendar months before declaring candidacy in 2015, and for calendar years 2015 and 2016.
PDC staff reviewed your allegations; the applicable statutes, rules, and reporting requirements; the response provided by Carolyn Merrival; and the applicable PDC reports filed by Respondent, to determine whether the record supports a finding of one or more violations.
Based on our findings staff has determined that, in this instance, failure to timely file F-1 reports of financial activities does not amount to an actual violation warranting further investigation.
Pursuant to WAC 390-37-060(1)(b), Carolyn Merrival will receive a formal written warning concerning failure to timely file F-1 reports certifying financial activities. The formal written warning will include staff’s expectation that Carolyn Merrival files complete, timely, and accurate reports in the future as required by statute and rule. The Commission will consider the formal written warning in deciding on further Commission action if there are future violations of PDC laws or rules.
Based on this information, the PDC finds that no further action is warranted and has dismissed this matter in accordance with RCW 42.17A.755(1).
